Wills
A will allows you to have limited influence in what happens to your assets upon your death. Wills must go through the probate process in front of a judge before they become effective. There are many pros and cons to wills.
Revocable Living Trust
A trust is a legal entity that can own property. This allows you to take assets out of your name and place them in the ownership of the trust. You would then appoint a trustee, someone you trust manage the property owned by the trust. You would also name a beneficiary. The trustee would have a fiduciary duty to act in the best interest of the beneficiary.
Power of Attorney
Documents that allow you to name someone that you trust to make decisions on your behalf when you are unable to do so for yourself. For example, if you were to be traveling abroad and are unreachable, or find yourself in unconscious.
Guardianship Documents
Documents that allow you to name someone to look after your children when you are unable. For example, if the child's primary caregivers are in a car wreck and are severely injured or killed. Next of kin may be several hours away, or unreachable, in which case the child may be taken in by police until the next of kin can arrive Worst case they may be sent into the foster care system until another option can be found, adding more stress and trauma to an already terrible situation.
